2. NATURE AND FUNCTION OF COOKIES

Cookies are small text strings that the websites (so-called Publisher, or “first parties”) visited by the user or different sites or web servers (so-called “third parties”) on which some elements may reside such as, for example , images, maps, sounds, specific links to pages of other domains on the site you are visiting, position and archive – directly, in the case of publishers and indirectly, that is, through the latter, in the case of “third parties” – within a terminal device (computer, tablet, smartphone, etc.) of the user himself. The software for browsing the internet and for the operation of these devices, such as browsers, can store cookies and then transmit them again to the sites that generated them on the occasion of a subsequent visit by the same user, thus keeping the memory of the previous one. interaction with one or more websites. The information encoded in the cookies may include personal data, such as an IP address, username, unique identifier or email address, but may also contain non-personal data, such as language settings or information about the type of device that a person is using to browse the site. Cookies can therefore perform important and different functions, including session monitoring, storing information on specific configurations regarding users accessing the server, facilitating the use of online content, etc. For example, they can be used to keep track of items in an online shopping cart or information used to fill in a computer form. For the conscious regulation of these devices it is necessary to distinguish the various types of cookies.

3. TYPES OF COOKIES

Cookies can have different characteristics in terms of time and therefore be considered based on their duration (session or permanent), or from a subjective point of view (depending on whether the publisher acts independently or on behalf of the “third party”).

According to the durationof the treatment, the following are distinguished:

a) “session cookies”, which are temporarily stored during the browsing session and are automatically deleted from the user’s terminal after closing the browser;

b) “persistent cookies”, which instead remain on the user’s terminal until a predetermined expiry date (for example, until the end of the year) or until they are deleted.

Depending on the personwho installs the cookies on the user’s terminal, the following are distinguished:

a) “first party cookies”, installed directly by the operator of the website visited by the user;

b) “third-party cookies”, installed by the operator of another website, which installs cookies through the first. The use of third-party cookies (temporary and permanent) by the Site is only anonymous and aimed at allowing the Owner to use web analysis services provided by third parties, to improve the user experience and graphic interface.

And yet the classification that responds to the rationale of the law and therefore also to the protection needs of the person, is the one that distinguishes, based on the purpose, two macro categories:

– technical cookies, used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contractor or user to provide such service “(see Article 122, paragraph 1 of the Code);

– profiling cookies, used to trace specific actions or behavioral patterns recurring in the use of the functions offered (pattern) to specific, identified or identifiable subjects, in order to group the different profiles within homogeneous clusters of different size, in so that it is possible for the owner, among other things, to modulate the provision of the service in an increasingly personalized way beyond what is strictly necessary for the provision of the service, as well as to send targeted advertising messages, i.e. in line with the preferences expressed by the user in the context of surfing the net.

Unlike technical cookies, profiling cookies are not necessary for the correct use of the Site and their use is conditioned by the user’s consent.

Below is a summary table of the different types of technical cookies.

Type of cookies

Function

Navigation cookies Browsing cookies improve the browsing experience and allow the site to function properly by storing browsing preferences and allowing, in particular, to: (i) view the contents in each user’s language from the first access. Navigation cookies are, in fact, able to recognize which country the user is connecting from and ensure that, every time he visits the site, he will be automatically directed to the version of the site set up for his country of origin; (ii) log in to the Site and access the Reserved Area. Thanks to navigation cookies, the site recognizes, at each access, a registered user as such.
Analytical cookies Analytical cookies are used to process statistical analyzes on the number of users and on the relative navigation methods of the site. Through analytical cookies, the Data Controller collects information in aggregate form and treats the results of the analyzes anonymously, to process general statistics on the service and its use. Analytical cookies are not essential for the functioning of the site.
Functional cookies Functional cookies allow the user to be recognized by the Site on the basis of certain pre-established criteria (for example, the language), in order to improve the quality of the service offered. Furthermore, these cookies allow the Site to recognize the user on the basis of a specific request (expressed, for example, by clicking on “Remember me”) each time the user visits the Site, so as not to force him to re-enter your access data. Functional cookies are not essential for the functioning of the Site, but they increase its quality and, at the same time, improve the browsing experience.
