Lgs. n. 196 of 30 June 2003 (hereinafter the “Code”), as per Regulation (EU) 2016/679 (hereinafter “GDPR”), as regards specifically the notion of consent referred to in Articles. 4, point 11) and 7 and Recital 32, as most recently interpreted by the Guidelines of the WP29 (Working Party article 29) adopted on 10 April 2018, ratified by the European Committee for the Protection of Personal Data (hereinafter “EDPB”) on 25 May 2018 and replaced by the Guidelines on consent under Regulation 2016/679 adopted on 4 May 2020, this

2. NATURE AND FUNCTION OF COOKIES

Cookies are small text strings that the websites (so-called Publisher, or “first parties”) visited by the user or different sites or web servers (so-called “third parties”) on which some elements may reside such as, for example , images, maps, sounds, specific links to pages of other domains on the site you are visiting, position and archive – directly, in the case of publishers and indirectly, that is, through the latter, in the case of “third parties” – within a terminal device (computer, tablet, smartphone, etc.) of the user himself. Cookies can therefore perform important and different functions, including session monitoring, storing information on specific configurations regarding users accessing the server, facilitating the use of online content, etc. For example, they can be used to keep track of items in an online shopping cart or information used to fill in a computer form. For the conscious regulation of these devices it is necessary to distinguish the various types of cookies.

3. TYPES OF COOKIES

Cookies can have different characteristics in terms of time and therefore be considered based on their duration (session or permanent), or from a subjective point of view (depending on whether the publisher acts independently or on behalf of the “third party”).

According to the durationof the treatment, the following are distinguished:

a) “session cookies”, which are temporarily stored during the browsing session and are automatically deleted from the user’s terminal after closing the browser;

b) “persistent cookies”, which instead remain on the user’s terminal until a predetermined expiry date (for example, until the end of the year) or until they are deleted.

Depending on the personwho installs the cookies on the user’s terminal, the following are distinguished:

a) “first party cookies”, installed directly by the operator of the website visited by the user;

b) “third-party cookies”, installed by the operator of another website, which installs cookies through the first. The use of third-party cookies (temporary and permanent) by the Site is only anonymous and aimed at allowing the Owner to use web analysis services provided by third parties, to improve the user experience and graphic interface.

And yet the classification that responds to the rationale of the law and therefore also to the protection needs of the person, is the one that distinguishes, based on the purpose, two macro categories:

Unlike technical cookies, profiling cookies are not necessary for the correct use of the Site and their use is conditioned by the user’s consent.

5. NATURE OF PERSONAL DATA AND LEGAL BASIS OF THE PROCESSING

Information has the right at any time to obtain from the Data Controller:

● confirmation as to whether or not personal data concerning him is being processed and, in this case, to obtain access to the same data (Article 15, GDPR), by making a simple request to be sent also by ordinary e-mail ( masseria@postasantacroce.it);

● the correction of inaccurate personal data concerning him (Article 16, GDPR);

● the cancellation of personal data concerning him, if one of the reasons indicated in art. 17 of the GDPR;

● the limitation of processing, when one of the hypotheses indicated by art. 18 of the GDPR;

● the portability of personal data concerning him, if the conditions established by art. 20 of the GDPR. The interested party also has the right to:

● oppose at any time, for reasons related to his particular situation, to the processing of personal data concerning him, in the cases provided for by art. 21 of the GDPR;

● lodge a complaint with the supervisory authority (Guarantor for the protection of personal data, based in Rome – 00187, Piazza Venezia, 11) pursuant to art. 77 of the GDPR, and possibly propose a judicial appeal against the supervisory authority itself (Article 78, GDPR) as well as against the Data Controller (or Manager) (Article 79, GDPR).

● obtain the transformation into anonymous form of the data concerning him, treated in violation of the law, as well as to oppose in any case, for legitimate reasons, to their treatment.

The aforementioned rights may be exercised against the Data Controller by using the contact details indicated above in paragraph 1.

Pursuant to art. 12, paragraph 3, of the GDPR, the Data Controller will provide the interested party with information relating to the action taken regarding his request, without undue delay and, in any case, at the latest within one month of receipt of the request (extendable term of two months, if necessary, taking into account the complexity and number of requests).

The exercise of the rights of the interested party is free. However, in the case of manifestly unfounded or excessive requests, in particular due to their repetitiveness, the Data Controller could charge a reasonable fee, in light of the administrative costs incurred to manage the request, or could refuse to satisfy the request.
